Welcome to Tikaw, your SaaS service created by KMCapitalGroup, a French company based in France. These terms and conditions govern your use of Tikaw, and by accessing or using Tikaw, you agree to comply with and be bound by these terms. If you do not agree with these terms, please do not use Tikaw.
1. Service Description
Tikaw is a SaaS platform developed and provided by KMCapitalGroup. It leverages artificial intelligence, specifically OpenAI, to generate content intelligently.
2. User Accounts
2.1 Registration: To use Tikaw, you must create a user account. If you create your account via the XPortal application, we retain your address in the database. This is necessary for the client benefit update process, which is calculated over the months.
2.2 Account Security: You are responsible for maintaining the security of your account and password. Notify us immediately of any unauthorized use or security breach.
3. Use of Tikaw
3.1 Acceptable Use: You agree to use Tikaw in accordance with all applicable laws and regulations. You will not engage in any activity that disrupts or interferes with the functionality of Tikaw.
3.2 Content Generated: Content generated by Tikaw is provided on an as-is basis. KMCapitalGroup does not guarantee the accuracy, completeness, or reliability of the generated content.
3.3 User Responsibility: KMCapitalGroup cannot be held responsible for the strict application of the content generated by the platform that may result in agent losses or decisions prejudicing the user's business and/or actions. The user is obligated to analyze and edit the generated content before any application/distribution.
4. Intellectual Property
4.1 Ownership: KMCapitalGroup retains ownership of Tikaw, including all intellectual property rights. You agree not to reproduce, distribute, or create derivative works based on Tikaw without our explicit consent.
4.2 Content Ownership: You retain ownership of the content you generate using Tikaw. By using Tikaw, you grant KMCapitalGroup a non-exclusive, royalty-free license to use, reproduce, and modify the generated content for the purpose of providing and improving Tikaw services.
5. Privacy
The collection and use of personal information are governed by the Tikaw Privacy Policy, which is an integral part of these terms and conditions.
6. Subscription Management
6.1 Cancellation: Subscriptions can be canceled with a single click from the client dashboard. You have the ability to manage and modify your subscription settings directly through the Tikaw client dashboard.
7. Cryptocurrency Payments
7.1 Payment Processing Time: Payments made with cryptocurrencies may take up to 2 hours to be processed. KMCapitalGroup is not responsible for delays in the processing of cryptocurrency payments.
8. Limitation of Liability
To the extent permitted by law, KMCapitalGroup shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use Tikaw.
9. Termination
KMCapitalGroup reserves the right to terminate or suspend your access to Tikaw at any time for any reason without prior notice.
10. Governing Law
These terms and conditions are governed by the laws of France. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the competent courts of France.
11. Changes to Terms and Conditions
KMCapitalGroup reserves the right to update these terms and conditions at any time. The date of the last update will be indicated at the beginning of the document.
